Just curious, but what is/should the legal standard for intoxication be? Not everyone throws up, or staggers, & suppose the man in question didn't witness his partner's drinking beforehand? Rape is a very serious offense, & it seems as though there's a lot of gray area here re: what does he know & when did he know it.
